本研究では、家族法の分野において法的枠組みが異なる法制度を比較するために、判例データベースを活用して、判例全文の中からキーワードにより具体的事実関係を析出するという方法論に基づいて、高齢者の意思能力喪失に際して裁判所が手続的にどのように関与すべきかにつき実証的に検討した。米国・英国については、判例全文を収録するオンライン・データベースであるレクシスを利用して、高齢者の意思能力喪失に際しての裁判手続を調査した。その結果、英米においては、後見制度はあまり利用されず、代替的システムとして信託、持続的代理権、リビング・ウイルなどが活用されることが明らかになった。例えば、英国では持続的代理権授与法が制定され、高齢者の意思能力が明確な時点に所定の書式に基づき予め代理人を選任し、代理人は高齢者の意思能力が失われた時点で、保護裁判所に代理権の登録が申請される。保護裁判所はこれを審査するとともに、代理人を監督する権限を有する。ドイツについては、家族法関連の判例全文データベースCD-ROMを利用した。ドイツでは、高齢者については後見制度が廃止され、成年者世話法という法律が制定され、高齢者が病気や障害のため身の回りの事務処理ができなくなった時点で、後見裁判所に申し出ると、裁判所は専門家の鑑定と本人の聴聞に基づき、世話人が選任される。後見裁判官と司法補助官が協力して世話人を選任・監督するが、裁判所の負担が加重になりがちであり、公的介護保険による財政的裏打ちが必要とされる。以上のように、欧米における成年後見法の改革動向は大別すると2つの流れが見られる。ひとつは、英米法を典型とする代替的システムによる補完であり、もうひとつはドイツ法を典型とする法定成年後見による規律である。わが国でどちらの規律を選択すべきか即断はできないが、今後の立法動向を見極めて、手続法上の問題点を指摘する論文をまとめたい。
