わが国では、国会の立法機能の形骸化が指摘されて久しい。三権分立が厳格に守られるアメリカの議会では、委員会や議員のスタッフが多く、議員立法の源泉になっている。わが国でも立法機能の強化には、議会スタッフの充実が不可欠との結論に達し、わずか一名ではあるが平成6年1月より政策秘書制度を導入した。しかしながら、単に、スタッフ数を増やせば良いわけではない。お手本とされたアメリカの委員会や議員のスタッフの役割などを調査・研究するのが本研究の目的で、大統領制のアメリカと議員内閣制のわが国とでは、一概に比較できないが、わが国では委員会スタッフの強化が望まれる研究成果となった。立法補佐機関の存在米英仏独日で議会事務局から独立して立法補佐機関があるのは、日本とアメリカだけである。立法補佐機関、議員秘書(公設のみ)、事務局・法制局・委員会のスタッフ数の合計では、アメリカが約2万4千人で群を抜き、フランスが5800、日本が5600、ドイツが4750、イギリスが3000人である。従って、数の上からいくとアメリカが例外的に多いと言え、わが国が特に少ないわけではない。アメリカでもスタッフの増強は戦後の現象で若手・中堅議員の長老支配に対する反乱が起こった1970年代頃から増えていった。議員スタッフの役割アメリカでは、厳格な三権分立の原則から議員立法しか認められない。但し、実質的な政府提案を議員名で提出することはままあり、成立法案のかなりの部分を占める。議員が提出する法案の大部分は、議員のスタッフが担当して作るか関連団体が持ち込む。議員のスタッフは、わが国で言う政務秘書も多く、政策担当ばかりではもちろんない。委員会スタッフの役割提出された議案は、各委員会又は小委員会で大幅にマーク・アップ(修正)されるのが通例である。ここでは、委員長や小委員長の意向を受けた多数党の委員会スタッフが多くの役割を果たす。少数党の推薦を受けた委員会スタッフもいる。下院又は常任委員会の常勤スタッフ30名のうち、10名が少数党スタッフである。議員の質問内容などは委員会スタッフが作成する事例が多い。最近の変化1994年の中間選挙で、共和党が上下両院の多数党になった。委員長は全員多数党から出るので、委員会スタッフも必然的に大幅に入れ代わっている。今までの民主党多数党下でいたキャリアを積んだベテランに代わって、共和党系の若手の数が増えた。また、委員会スタッフも削減の対象になっている。
