Criminal Justice and Mental Health Law after the draft of "Treatment and Probation Law for Individual Committing Grave Act under Insanity"-Treatment of the Mentally III and the Addicted-

(1)在这两个问题上，法律专业人士和实务界存在着很大的分歧，即：（1）精神卫生工作者对“难治性病人”的接受态度消极，而律师则认为他们应该由精神卫生系统来治疗。(2)律师倾向于考虑精神病患者的犯罪行为，而精神卫生保健人员则认真考虑医疗的可治疗性。(2)新法律中，社区卫生保健系统对门诊罪犯的合作很薄弱。(3)安非他明成瘾者的治疗和护理在日本是一个严重的问题，我们不得不假设新法会遇到困难。

(1) There exists great gap between law professionals and practitioners concerning the two issues.Namely:(1) Mental health care staff are negative to accept the "refractory patients," while lawyers think they should be treated by the mental health system.(2) Lawyers tend to take dangerousness of an mentally ill offender, while mental health care staff consider the medical treatability seriously.(2) The cooperation in the community health care system for the offender-outpatient is weak in the new Law.(3) Treatment and care of the amphetamine addict is a serious problem in Japan and we have to assume the new Law will find difficulties.
