项目摘要

今年度は、法的トポスとの関わりの中で、トピク的思考、体系思考、可動的体系、一般条項、そして国連売買条約(CISG)における信義則に関するメタ知識の諸テ-ゼを抽出し、法的トポスが問題提起しているものが厳密に見れば何かを明らかにしようとした。そして特に、(1)メタ推論において本研究を通して抽出されたメタ知識を利用できるようにし、(2)CISGのメタ知識の分析結果をテキスト文の形で提供し、法律エキスパートシステムでコメント文として出力できるようにする、ということに照準を合せて分析をした。法律学における体系を背景にした上で、信義則に基づき法的価値判断をしなければ、それぞれの事案における価値判断の内容の整合性・一貫性はとても維持できず、恣意的なものとなる危険性が大きい。こうした認識の上に立てば、体系思考の中では一般条項や信義則はどのような位置を占めるのか、また体系思考とトピク的思考の関係はどのようになっているのかを明らかにする必要性は極めて大きいと言えよう。信義則の個別的法命題である法的トポスは法規範の硬直した適用・思慮を欠く適用に対して指針的役割を果たし、それと同時に、より高次のメタルールによって制御されているが、こうした場合、トピク的思考と体系思考が排他的関係にあるのではなく、相互に補完・浸透しているという認識が重要である。不衡平または不合理な解決がなされようとする時、法的トポスがそのような解決を斥けるための理由を提供すると言われているが、今回抽出した体系思考やトピク的思考等の構造的知識は相互に関連しており、全体的に見ると、信義則に基づく法的価値判断の背後で目立たないが確かに機能している推論の制御を目的とする論理的な集合体と言えるであろう。
