项目摘要

本領域は平成16年度に開始し平成21年度が最終年度であった。しかし全体の取り纏めのために本補助金を申請したところである。その取り纏め事項の主な事柄としては、全体の取り纏め的業績発表と、集積した判例データの今後の活用方策を明らかにすることの二点であった。前者については各班の代表者による分野別レポートを取り纏め、Japanese Yearbook of International Law 53巻に掲載されたところである。後者については、1001件の判例英文データを取りそろえたプロジェクトはこれまでになく、このデータの価値を維持するためには新判例を継続的に翻訳して加えてゆくことが必要となるところ、領域終了後補助金なしでそれを可能にするための方策が必要であった。そこでそのための方策として、民間企業にデータを移管し、営利ベースで継続することが最も持続性が高いと判断された。そこで複数の民間業者と協議を重ね、本報告書執筆時点では一社に絞られた。2008年の経済危機の影響でリーガルビジネスは多大な影響を受けた。この経済危機と日本政府が導入した破たん企業救済策がリーガルビジネスに与えた影響は大きく、それを踏まえた持続可能な営利ベースのモデルの協議に予想以上の時間が必要となった。ほぼ1年かけて試行錯誤してきたが、ようやく形が見えてきたところである。また最近、この企業のアメリカ本社の担当役員とテレカンファレンスを行い、さらに協議を進めえたところである。
