Integrated Studies on Arbitration in International Transaction

为了激活国际商事仲裁在日本的使用，从理论上讲，不仅需要通过促进当事人的自治来加强仲裁员的权力，而且需要限制国家法院干预仲裁过程的权力。从实践的角度来看，需要确保日本仲裁法的透明度，并在日本法学院和法学院引入系统有效的仲裁教育。

In order to activate the use of international commercial arbitration in Japan, it is required from a theoretical point of view not only to strengthen arbitrator's power by facilitating parties' autonomy, but also to restrict state courts' authority to intervene in the arbitration process. From a practical perspective, it is required to secure the transparancy of the Japanese arbitration law and to introduce a systematic and effective education of arbitration in Japanese law faculties and law schools.
