项目摘要

現在、道路やごみ処理施設の都市計画の決定手続及びその内容をめぐって利害対立が多くの地区で生じている。このような利害対立によって、行政、住民双方に多大な時間的、心理的、経済的損失が生じている。本研究はこうした状況を踏まえて、都市計画決定手続の改善方策に付いて検討するものであり、以下の手順で研究を遂行した。まずはじめに既存の社会資本整備に関する計画策定手続研究について整理している。計画行政、行政手続、住民参加などの分野の諸研究をとりあげた。次に、近隣公園並びに一般に嫌悪施設と呼ばれるごみ処理施設建設の計画決定までのプロセスについて具体的な事例をもとに整理した。その過程で誰がどのような主張や行動をし、どのような利害対立が生じ、どのように解消されたか、をまとめている。また地方公共団体に対して、都市計画事業の計画策定手続きについてのアンケートを行い、具体的な都市計画法の運用状況を明らかにした。最後に、都市計画決定手続きのモデル化を行って、都市計画地方審議会の役割について検討している。現行の手続きは、地区住民にとって必ずしも十分な情報が与えられておらず、選択肢もない状況で決定される可能性が高い。この場合、最終的な利害調整は現行制度においては都市計画地方審議会に委ねられるが、ここでも住民がその審議基準に対して十分な情報を有していない場合には、社会的な損失が生じることを明らかにした。行政及び都市計画地方審議会の説明責務(accountability)をより明確にすること、そして説明会での情報交換が円滑となるような場を設けることにより、行政と住民の情報の非対称性を改善することが重要である。
