本研究は社会資本整備をめぐる用地取得の困難性に着目し、以下のことを行った。1)事例分析に基づく利害対立状況の整理、2)現行の利害調整システムの問題点の抽出、3)社会における利害調整手段を踏まえた改善方策の検討。まず、利害対立要因には事業の目的、その実現手段、計画策定手段、事業による利益、の4要因があることを示した。ここで前3要因に関する利害対立は計画策定段階での争点であり、その段階での利害の不調整が事業による利益をめぐる利害対立を拡大させ、逆に事業による利益をめぐる利害対立が目的や手段、手続をめぐる利害対立を引き起こすという循環構造が存在していること、またこの利害対立状況は、いわゆる「囚人のジレンマ」と呼ばれる構造であり、この構造が用地干渉を通じてゆがめられ、解消を困難にしていること、を明らかにしている。次に現行の用地取得関連法制度の整理を通じて、我が国の社会資本整備における計画策定段階には利害対立構造を明らかにした上で妥協を図るという手続きが不十分であり、事業者が先手として行動するために、地権者の選択肢が制限されていること、地権者の交渉に応じるインセンティブが不十分であることなどを示している。「囚人のジレンマ」の解消方策は、経済学、社会学、心理学等で広く研究されてきているが、ここではそれらの成果を整理し、まず利害対立主体が互いにその構造を理解することが前提であり、その次に清算の手段として、利得構造の変更もしくは第3者への委託が求められることを示している。最後に、関係権利者が利害対立状況の理解をした上で計画決定を行うこと、また補償制度の見直し、弁護士など専門家の活用が用地取得の円滑化に寄与することを示すとともに今後の課題を明らかにしている。
