研究実施計画で示したように(1)用地取得方式選定の状況把握、(2)用地買収方式及び減歩換地方式による整備事例の比較、(3)各方式の適用可能な地区条件の検討を行った。まず、(1)用地取得方式選定の現状把握については、実務担当者からのヒアリングをもとに選定の基準について整理を行い、現状では方式の比較といった観点からは選定がなされていないことを明らかにした。またこの一因として両方式の整備によって土地利用等にどのような違いが生じるのかが不明であることが指摘され、本研究に意義があることが示された。次に、(2)両方式の整備事例の比較については、同じ幹線道路でほぼ同時期の整備であり、従前の土地利用がほぼ等しい2地区を取り上げ、床面積の相違、転出世帯数、土地利用の変化等の調査を行った。その結果、用地買収方式でおこなった地区においては民間ディベロッパーの介入により減歩換地方式とほぼ同等の床面積の増加がみられること、また、本来転出する必要のない減歩換地方式においては、必然的に転出を伴う用地買収方式の地区とほぼ同等の転出世帯数があるなど一般の住民説明用のパンフレットの内容とは異なる結果が得られた。効率性の観点からはどちらが望ましいとの判断は難しく、また負担の公平性の観点からは、用地買収方式は受益者と負担者の関連づけが弱いのに対し、減歩換地方式では、土地区画整理事業の手続の中で公平性の議論がなされ、受益と負担のバランスが比較的明確になっていることを明らかにした。これらを通じて両方式の相違点を明らかにした。(3)各方式の適用可能な地区条件については明確な整理はできなかったが、事業化の過程において住民の意志をより反映させ、住民と行政の役割を具体化し、用地買収、減歩換地及びその折衷方式も含めて整備方式を検討していくことが重要であることを示した。今後、住民参加のあり方について、開発利益の還元、受益者負担、損失補償等幅広い観点から研究が必要である。
