项目摘要

本研究の目的は、子どもに対する義務の根拠についての基本概念を分析した上で新たな主体像を提示することで、既出の説の射程や限界を検討してより包括的な養育義務の議論を発展させることである。本年度は、親の責務の自発的引き受けを義務の根拠とする自発説を取り上げ、「自発的引き受け」の概念を検討した。フェミニストたちによる母親業の議論やエヴァ・フェダー・キテイによるケアの倫理の観点から、「自発的引き受け」を行う主体のあり方を問い直すことで、自発説をより包括的なものへ修正する主張を展開した。それらによると親の責務は「自発的に引き受けられたものでも、強制されたものでもない」ものでもあるのである。これは親の義務が「役割責務」であることと関わる。すなわち、その二項対立は親の責務は契約による役割責務なのかどうか、という問題でもあるからだ。役割責務について考察することで、自発説の修正案を導くことができた。すなわち、親の義務は契約によらない役割責務の側面もあり、それは反省可能な役割責務であるべきであるということだ。この研究結果は日本医学哲学倫理学会大会によって口頭発表し、それに修正を加えたものを論文として同学会誌に投稿した。
