1.目的 海浜地および山林地の利用実態を明かにし、それが環境をどのように破壊ないし改変させているかを調査する一方、その法的・行政的制度の現状を明かにし、海浜や山林の破壊と保全の経済学的意味を分析し、さらに、環境保全の運動を社会学的に明かにし、外国の制度をも参考にしつつ、海浜地および山林地の利用と環境についてあるべき制度を追求する。2.経過ならびに成果の概要 上記の目的を達成するため、今年度は、第一に、海浜地および山林地の利用と環境につき従来の研究水準を踏まえて、次のような問題意識の下に、実態調査を行った。すなわち、(1)海浜利用とくに埋立について、(ア)埋立および埋立地上における産業的施設の立地を住民の海浜へのアクセスについて、高砂など。(イ)埋立と漁業権の関係について石垣島、志布志、苓北など。(ウ)公有水面埋立法について各地域。(エ)海浜環境の保護を含む現行法、とりわけ瀬戸内海環境保全特別措置法の実効性について織田ヶ浜など。以上の予備調査を踏まえて、研究会で議論を行った。(2)山林地の利用について、(ア)自然環境保全法に基づく地域指定の進行について、(イ)同法に基づく地域指定とミニ自然破壊について、問題が提起され、次年度の調査のための検討がなされた。また、既に開発が行われた地域(南アルプス・スーパー林道)について、それが所期の効果をもたらしているか否かとの点に重きを置いた調査を行い、検討が加えられた。(3)ナショナル・トラスト運動について、(ア)この運動を実効的たらしめるための法的措置について、(イ)自然保護の方策としてナショナル・トラストが十分な方策であるか否かについて、問題提起され、知床(斜里町)および天神崎(田辺市)について予備調査を行った。
