项目摘要

〔目的〕私たちの社会には、法律を始めとして、規則,道徳,掟,慣習などさまざまな「社会的ルール」が存在する。これらのルールは独立したものではなく、相互に関係を保ちながら重層的な構造を保っている。本研究は、これら多様なルールが、全体としてどのような構造を持ち、その中で個別的なルールがいかなる働きをするのか、そのシステムを、社会調査によって明らかにすることを目的としている。〔方法〕(1)被調査者大阪府下に在住する成人男女を母集団とした。(2)抽出方法大阪府下を都市部と農村部に階層化し、住民台帳の中から、それぞれ400人ずつを二段無作為抽出した。(3)質問紙の内容新聞紙上で報道された過去の事件の中から、新宿西口バス放火事件,日航機長逆噴射事件,外国人指紋押なつ拒否事件,四つ子選択出産事件等12の事件を選び、それぞれの事件が、どのような社会的ルールによって処罰されると思うかを問うた。また、それぞれの社会的ルールの性質についての質問、人びとの価値観、政治的態度、道徳観、各種のデモグラフイック属性を問う質問が含まれている。〔結果〕社会事件の中には、法律のみならず道徳や規則など複数のルールによって処罰されるものと、法律上は罪になるがそれ以外のルールからは処罰されないもの、またそれと全く逆のケースなど、いくつかのタイプのあることが明らかになった。その意味で、社会的ルールは、相互に関係を保ちながら、全体として社会の秩序をレギュレートしているようである。またこれらの処罰の与え方は、地域のもつ社会的規範や、各人の道徳性、価値観、政治的イデオロギー、それに性、年令、学歴といった個人属性によって、強い影響を蒙っていることが明らかとなった。
