1.まず、わが国借地借家法の沿革を辿りつつ、その性格的・構造的特徴を確認・整理する作業を行った。ここでは、(1)その普通法的性格(民法の不備の補充)、(2)昭和16年改正と戦後の判例・学説の発展によって結果的に付与された社会法的性格(とくに借家法の場合)とその構造的特徴(現存賃借人の利用権保護の「永続性」)、(3)住宅・宅地政策としての役割の消極性(住宅・宅地政策の不十分さを不動産所有者の犠性において補完するもの)などの諸点を明らかにした。2.他方、戦後の住宅・宅地政策の展開過程との関連では、(1)民間賃貸住宅の適確な位置づけがないまま建設戸数主義がとられたため、高度成長下での木賃アパートの累増が生じたこと、(2)加えて持家主義の偏重とその結果でもある地価上昇とにより、借地借家法の果たすべき役割に歪みと部分的な機能不全(とくに借地供給の停止)が生じたこと、(3)昭和41年改正も、都市の新しい発展への対応は試みたものの、住宅・宅地政策との内在的な連絡調整の確立という課題は末解決なままに残したこと、そして、(4)これらの点は、西欧諸国の借家法が早い時期から住宅政策の一環としての明確な位置づけを与えられたのと大きく異なる点であること、などを検討した。3.以上の考察の結果と現下の借地借家法改正問題の主要論点を突きあわせることにより、(1)現下の改正問題は、一面では、上述した点の不備の補正を志向するものといえるが、他面では、それを、従来の住宅・宅地政策の枠組をかえることなく借地借家法の改正だけで実現しようとしている点に大きな問題があることを明らかにした。(2)そのことは、東京・関西・名古屋で行った聞取り調査の結果によっても確認される。(3)このような分析結果の一部は、すでに別掲の論文でも発表したが、さらに、右の問題を克服するための法制度的課題にも言及した研究成果のとりまとめ作業を現在進めているところである。
