1.来たるべきわが国の高齢化社会での高齢者の生活保障については,(イ)社会保障・社会福祉政策の整備によるだけでなく,(ロ)高齢者自身が自助努力を強化し,(ハ)その家族も相応の役割を担うことが,従来から期待されてきたが,近年の関係諸政策の内容を広い視野から検討してみると,そうした要請は一層強まっていることがわかる。しかし他方で,それらの諸政策においては,右の(ロ)と(ハ)の要請が場合によっては相互に対立する方向性をもつことが必ずしも十分に意識されていないことも,また明らかになった。(ハ)に関して民法上の扶養意識を喚起するという発想はあっても,それを(ロ)と関連づける際に必要となる“相続の問題"は未だ十分に意識されていないことが,その1つの理由であろう。2.他方,(1)本研究のテ-マに関連する最近の各種の調査結果等を整理・分析してみると,現実の家族における扶養や相続意識(もしくはその実態)には,(イ)高齢者の自立・自助志向の強まり,(ロ)生存配偶者(妻)への相続分割の増大,(ハ)介護を含む扶養(=負担)と相続(=受益)との間の一定の関連づけなどにつき,明白な変化が生じつつあることをみてとれる。しかし,その変化は未だ始まったばかりであり,右の全体あるいは(ハ)のところだけを,二世代間で事前に“契約的に処理する"というような発想には,まだかなりの距離がある。(2)民法理論や裁判例の動向も,例えば息子の配偶者の寄与に対する評価など,なお今後の発展が期待される段階にある。3.フランスでは,社会保障・福祉施策の充実とあいまって大部分の高齢者が最後までほぼ自立した老後を送っていること,その介護等の社会的費用の負担も,家族というより相続財産の負担とみなされる側面が強いことなどとも対比すると,日本型福祉社会における新しい家族秩序形成の方向を見定めるためには,なお相当期間にわたる持続的な調査研究が必要となるように思われる。
