1.東京都の最も代表的な水源林である多摩川上流の水源林について、山梨県塩山市をはじめ東京都奥多摩町付近の実態を調査し、青梅市にある東京都水源林管理事務所で聞取及び資料蒐集をおこない、沿革、運用、住民意識を含む村落構造についての知見を得た。2.前橋営林局管内各県の水源林、とくに国有林内の実態について河川の管理状況をアンケート調査とボーリング調査により調査した。その結果は、別に報告書にまとめているが、森林内の上流河川が河川法の適用を受けない普通河川であるため、管理上の法的責任がきわめてあいまいにされていることが判明した。すなわち、営林署、県、市町村、地区等それぞれが適宜に管理している状況にあり、且つ上部機関については建設省と林野庁とで管理主体を異にすることがあり、不明瞭である。3.とくに水害や地すべり、土砂崩れなどの災害にあたっては、裁判所の判断は極めて不明瞭であり、天然自然の風水害を原因とする災害に対して堤防やその崩壊防止の工事の及ばざることのみを強調するあまり、被害の再発防止はもとより現実の被災者を救済する手段さえ極めて法的には不備であることを暴露している。4.河川の流水利用権については、民法上は慣習上の物権とされているが、河川行政にあたる建設省の管理体制が一貫しているため、行政庁の許認可手続きとされ、慣習法が、侵害されている観を呈している。さらに慣習上確立した流水利用権の実態把握が必要である。5.多目的のダム建設にあたって、地元部落と市町村との間にその所有・利用・補償等をめぐる紛争対立があり、既に数年間訴訟中の事件もある。権利関係を明らかにするため法社会学的調査をおこない一定の成果を収めた。6.本テーマについての研究は、今後も継続したいと考えている。
