国際法上、自衛は従来から国家の基本権とされてきたが、近来は違法性阻却の抗弁として扱われる傾向がある。これは自衛が「原則」か「例外」かの問題であり、現実の適用において大きな差がある。本研究は、この点を考察の契機とし、自衛概念を最近の国家実行を中心に再検討するよう試みたものである。本年度はその第一段階であった。まず(1)基本文献の検索・収集・カ-ド化及び(2)先例の検索・収集・先例リストの作成を行った。それに並行してこれまでの自衛理論・学説を整理し、いくつかの代表的事例も分析した。得られた研究成果の一部は法学論叢第126巻に発表した。これは自衛概念の位置づけと自衛の条件について、詳細な理論的議論に立入ることなく思考の手がかりを探り、来年度以降の研究の進展に継ごうとした。この論文では、自衛と国内法上の正当防衛の相違を認識し、特に武力行使禁止の前後での自衛の意味の変化を明らかにする。武力行使禁止以前は、カロライン号事件とヴァ-ジニアス号事件をとり上げ、自衛が様々な状況下で多様な形で援用されていること、国家の基本権としてより違法性阻却の抗弁として主張されていることを示した。これ以後では、概念上、国連憲章で新しく集団的自衛権が登場し、同時に自衛の条件(武力侵略、必要性、比例性、集団性)が明確になる。実行上も、キュ-バ封鎖やマヤグェス号事件その他の検討すると、自衛は抗弁であるように思われる。さらに最近の「ニカラグア対米国事件判決」は、集団的自衛の条件を、武力攻撃の存在、被害国たる宣言、援助の明示的要請の三要件とし、また必要性と比例性の要件についても明示した重要先例である。この論文を手始めに、すでに収集した国家実行例から、その変遷・集積を横断的に分析し総合して、自衛の新しい理論構成を試みるべく研究を継続中である。
