本研究においては、地域住民の法的経験を起点にすえ、それを多角的に分析することを通じて、地域社会の変動と住民の法行動との関連性を解明することを試みた。研究の一環として実施した福島県棚倉町における質問票調査の(中間的)とりまとめの結果、以下の点が明らかになった。ー1.調査対象者の経験した法的問題類型としては、近隣紛争が最も多く、ついで自動車事故、契約紛争、行政紛争、家事紛争、その他の順であった。このうち近隣紛争においては、伝統的な紛争のほか、地域の生活構造の変化(伝統的農業地域への宅地的土地利用の浸透など)によって、当該地域における標準的行動様式や先住性の意味などを争点とする紛争の顕在化が見られた。2.調査対象者の紛争解決行動を通じて、紛争解決の伝統的な準拠集団としての地域集団の解体とそれに随伴する公的機関への依存現象が見られた。しかし同時に、とりわけ公的機関が当事者性をもつケ-スにおいては、地域住民の、伝統的な「公」への受動的姿勢がなお根強く残っていることも確認され、地域社会の変動と住民の法行動をめぐる複雑な交錯関係が明らかにされた。3.今回の調査の過程で、調査対象者の「自己の主張の内容」の説明が、なんらかの基準(法、地域の慣習、「常識」など)に焦点を合わせた説明(ル-ル志向型)と、相手との広い意味での社会関係に焦点を合わせた説明(関係志向型)に分岐する現象が見られた。この二つの類型の分岐と他の諸因子との間には現在のところ明確な相関は認められず、この点は、今後の課題である。このことにも関連し、調査対象者においては「権利」の観念がかなり拡散的に使用されており、これらの地域住民の意識構造における「権利」観念の属性についてさらに調査を深める必要がある。なお、上記の調査のほか、今後の比較研究の予備的調査として、他地域において若干のケ-ススタディ的な聞き取り調査をおこなった。

This study attempts to clarify the relationship between the social and economic development of the region and the legal activities of the region. The results of the questionnaire survey conducted in Fukuoka, Fukushima Prefecture, are as follows: 1. The type of problem of the investigator's investigation method, the neighbor dispute, the automobile accident, the contract dispute, the administrative dispute, the family dispute, and the other. The dispute between neighboring countries, the dispute between traditional countries, the change of regional living structure (the penetration of land use in traditional agricultural areas), the standard action mode when the area is located, the dispute between the meaning of pre-existence, and the dispute between the two countries. 2. Dispute resolution actions by investigators, dispute resolution systems, and the dissolution of regional groups and accompanying public organizations are seen. At the same time, the public organs are related to the nature of the parties, the local residents, the "public" and the affected posture, the root of the strong residual, the recognition of the local society, the movement of the residents 'legal actions, the complex cross-relationship, and the clear relationship. 3. In this paper, the process of investigation, the description of "the content of one's own opinion" of the investigation target, the standard (law, regional custom,"common sense"), the focus, the description (goal type), the meaning of the social relationship, the focus, the description (relationship goal type), and the phenomenon of divergence are seen. The difference between the two types and the factors in the future is clear. This is related to the subject of the investigation, the use of the concept of "profit", the construction of the consciousness of the inhabitants of the region, the attribute of the concept of "profit", the necessity of the investigation. The investigation of the above report and the preliminary investigation of the future comparative study shall be conducted in different regions.
