项目摘要

本研究はUNCITRAL国際商亊仲裁モデル法(1985)がその後各国の国内法としてどれだけ取り入れられているかを調査することを目的とするものであった。(1)そこで,1985年以降仲裁法を新たに制定しまたは改正した国およびそれを準備中の国につき、その仲裁法ないし仲裁法案を入手し,その内容を検討した。その結果,カナダ(連邦と州),オ-ストラリア(連邦),アメリカ合衆国のいくつかの州でUNCITRALモデル法をそのまま国内法化しており,オランダ等いくつかの国で部分的にモデル法の影響を受けた改正を行っていることがわかった。このほか,イギリス,香港等で,委員会の報告書が公表されている。(2)上記作業と並行して,日本ではUNCITRAモデル法にどういうスタンスで対処すべきか,について考察した。その一端を公表したのが、「仲裁法改正の基本的視点と問題点」(三ヶ月章先生古稀祝賀・民事手続法学の革新(上)529頁以下〔1991年・有斐閣〕である。(3)上記(1)の作業の過程で入手したイギリス新仲裁法案(1990年11月)とそのコメンタリ-につき,東京大学大学院の演習を利用して徹底的に検討した。この法案は,その修正案が検討されつつあるとのことであるが,国際商亊仲裁を一つの「見えない貿易」としてロンドンに集中しようとしているイギリスがどの程度までUNCITRALモデル法と伝統的なイギリス仲裁法を妥協させようと考えているか、について興味深いサンプルを提供している(これについては,何らかの形で公表したいと考えている)。

This study is based on the UNCITRAL International Commercial Arbitration Act (1985), which is used to investigate the domestic laws of various countries. (1)Therefore, the new Arbitration Law since 1985 has been formulated, revised, and prepared. The Arbitration Law and Arbitration Bill are being discussed. As a result, the United States of America, the United States of America, the United States of America, The Committee's report was published in the form of a report by the Secretary for Foreign Affairs, the Secretary for Foreign Affairs and the Foreign Affairs. (2)In parallel with the above work, Japan has been investigating the UNCITRAL Law. "Basic Viewpoints and Problems of the Correction of Arbitration Law"(Congratulations to Mr. Akira, March 1991), pp. 529 and below. (3)(1) The process of the operation was initiated by the New Arbitration Act (November 1990), which thoroughly investigated the use of the University of Tokyo's exercises. This bill is to be amended by the amendment to the International Commercial Arbitration Act, which provides for compromise in the arbitration of UNCITRAL's traditional arbitration law.(,).
