1.アリストテレス[以下Aと略称]の学問体系中、正義論は幸福論の一環として、全般的徳としての正義と、法的領域における特殊的正義に区別され、後者は配分的正義と矯正的主義に区分される。2.Aは、プラトンの『国家』、『法律』を批判し、ソクラテスとプラトンの共有制論に反論する形で財産等の私有制を主張し、あるものの他のものへの完全は帰属を所有概念の本質とみたことが、矯正的正義の概念形成の前提となっている。他方、人間の霊魂のうち理性的部分が感情的部分を支配し、霊魂が身体を支配し、生まれながらの支配者が被支配者を支配し、人間が家畜を支配する、という自然に一致した有用な支配の体系を承認したことが、配分的正義の概念形成の前提になっている。3.Aの正義論は、主意主義および権利概念を媒介とした近代的正義論とは異なる。4.国家は、一対の男女の共同体および生来の支配者-被支配者の共同体を起点に、家、村を経て、最終的に完全な自足の限界に達した。人間の自然的結合の完成形態として捉えられているが、これは「至高の善きものを最も熱心に目指す共同体」として、幸福論の一環を構成し、かかる完成した全体としての国家はその本性上、「家やわれわれ個々人より先にある」とされる。5.売買等の随意的交渉(契約)は、矯正的正義の典型例の一つとされるが、商人や高利貸しによる財の獲得は非難され、利子の獲得は反自然的として否定される。6.Aは、「人間は自然に国的動物である」として人間の自然的社会性を承認し、そうした人間が「善き生活」をするための共同体を形成するためにはどのようにすればよいか、という問題意識の枠組みの中で正義論を展開している。7.こうして、Aの正義論は、帰属概念を本質とする私的所有の承認に立脚する点で、近代的法制の基礎にも通じたが、自然的支配関係を強調した点で、個人主義的な思想(ルソーなど)から批判されたと考えられる。
