项目摘要

本研究では、EC主要諸国の技術的安全性に関する規制法制がEC統合によりいかなる変動を生じたかを、ドイツなど若干のEC構成国を対象として明かにすることであった。特に、ECの理事会指令の国内法への導入と、それに際してのの主要構成国の固有の法制の相互の調整という現象を対象にすることにより、技術的安全性管理法制がその国固有の必要性、特性と国際的要因とに影響されて示す変動現象を客観的に明らかにし、最終的にはわが国の法制度の現状との比較をすることにより、技術的安全性規制法制の行政法学的研究を行うことを目標とした。研究経過を概観すると、従来より筆者が研究対象としてきたドイツについては、技術監視協会、DEKRAなどの技術者団体の調査を行い、他の諸国へのそれらの参入、他国の技術者団体のドイツへの参入の相互関係を調査し、それらの活動が法制度の上でも、従来の独占状態から競争の導入へと進んでいることが明かとなった。これら2団体については、現地調査も行った。他の諸国について、ロイド船主協会などイギリスを中心に若干の資料調査をし、法令政府資料などの若干を資料収集したにとどまるが、現在のところ、ドイツの技術監視協会と政府の関係と比較して、他国の技術者団体の行政補助の法的システムがどのように形成、運用されているかの分析を行っているところである。分析の中心領域は、営業関係規制法、道路交通関係規制法に限定しているが、暫定的にまとめるならば、ドイツなど従来から特定の専門家団体を独占的に技術監視行政上活動させてきた国でも、EC全体の専門的自営業種の規制緩和政策の影響を受けて、参入制限をはずしつつあるということが明らかになった。今後は、技術管理上の、規制と独占の関係、機能的行政組織論の深化が課題である。
