项目摘要

昨年度は福祉国家的介入主義の下での伝統的契約理論の変容を探究してきた。その結果、この問題はひとり契約法にとどまらず、裁判論、あるいは法理論一般にも大きなインパクトを持ついくつかの重要な知見を含んでいることが明らかになった。まず契約法概念に関しては、古典的な一回的合意に基づく閉鎖的システムとしての契約法から、当事者の相互的なかかわり合いのプロセスという開放的システムとしての契約法という新たな構想を示すことができた。すなわち、契約締結時の一回的ないわゆる「大文字の合意」により契約規範が全面的に確定されると考えるのではなく、契約規範は当事者の継続的な関係性の中での個別的な「小さな合意」により、漸次的、暫定的に形成されてくるという新たな観点を提示した。つまり、契約とは当事者間の関係を将来に向かって「縛る」ためのものではなく、むしろ新たな関係形成のための一つの暫定的結節点として理解されるべきであると考えた。またかかる構想がわが国のみならず、ドイツ、アメリカ等においても同時的に発表されつつあることが判明した(この意味ではわが国の契約法理論の方が現在理論的に欧米に先んじている面もある)。次に、裁判においてかかる開放システムとしての契約法がまず当事者の交渉関係の促進規範として機能しているという新たな側面を提示することができた。終局的な裁断規範としての契約法という伝統的パラダイムに対し反省をせまるものである。ここでは契約法は「交渉促進システム」として把握されることになっている。そしてかかる観点から伝統的契約法規定・法理の見直しを進め、契約当事者間の関係調整に役立つ解釈論の提示も行った。最後に法理論一般に対しては、契約ルールの検討を通じて規範やルールというものの見直しを促す提言を行った。ここではルールとは後の状況をすべて現在に置き換えて将来を拘束するものではなく、むしろ不可避的に状況依存的なものであることを主張した。そしてかかる観点は近時の法哲学や法理論において問題とされている規範の一般性と個別性・状況性の問題とリンクしていることを明らかにした。
