The purpose of this research is to identify and to analyze legal issue on the role of the intention of decedent on the phase of successionThe research methods are study on some case related to the testament which makes some property succeed to some heir.The main topics of the research are as follows ;(1)tendency of the cases that the intention of decedent precede the rule of the civil law on succession.(2)rapprochement of rule of the division of tenancy in common and rule of the division of legacy.

本文的研究目的是对被继承人意思表示在继承阶段的作用这一法律的问题进行辨析，研究方法是以遗嘱为继承人继承财产的案例为研究对象，主要研究内容如下：（1）被继承人意思表示优先于民法继承规则的案例的发展趋势。（2）共有权分割规则与遗赠分割规则的协调。
