1(1)本研究の成果は、自治研究誌に4回にわたって論文として公表することができた。研究の蓄積の著しく乏しい分野であるだけに、今回の比較研究は公物法理の今後の研究にとって、一つの基礎的な分析として参照される機会が多い者と考える。2研究の具体的内容(1)本研究ではわが国の伝統的な公物法理論がモデルとしてきたドイツ法の変化を追い、現段階のドイツ法理論の状況を(不満足なものではあるが)概観してきた。そこには、公物の利用関係を権利の体系として構築しようとする努力や、基本権(とくに表現の自由)との関連で公物法制の指導指針を探求する解釈論、公物の公用開始・廃止における行政手続の整備・市民参加の拡充、合意形成型組織としての営造物の活用など、わが国の伝統的な理論の知らなかったドイツ法の進展を数多く確認することができた。結論として、わが国の公物法論は古いドイツ法の段階で固定している状況を明確に示すことができた。今後は、ドイツの道路法が権利の体系として法文を置いていたことなどを参考に、立法論のレベルでも改革が必要であることを示唆している。(2)ドイツ法の研究を通じても今回の研究でなお充分な比較のできなかった課題としては、法定外公共用物の管理法理論、総合調整のシステム化の問題がある。今後は、(1)計画手法、(2)通達手法、(3)契約手法、(4)手続手法、(5)組織手法、(6)事務区分による手法、(7)人事手法といった手法について、比較法研究及び実態分析が課題となろう。

1. The results of this study are as follows: A comparative study of the accumulation of public property and future research on the basis of analysis and reference opportunities 2. The concrete contents of the study.(1) This study summarizes the theoretical status of traditional Chinese law. The relationship between the use of public property and the construction of a system of public property (Freedom of expression) and the relationship between public property and legal guidelines for exploration, discussion, public property, the beginning and end of public administration, the preparation of public participation, the formation of consensus-based organizations, the use of administrative creation, the development of the theory of national systems, knowledge and law, and more. The conclusion is that the state of the law is fixed. In the future, the road law will be reformed in accordance with the law. (2)The study of the law of the United States and the current study of the law of the United States and the law of the United States and the law of the United States In the future,(1) planning technique,(2) access technique,(3) contract technique,(4) manual technique,(5) organization technique,(6) business division technique,(7) personnel technique, comparative method research and state analysis are the subject of research.
