(1)本研究では、複数国家(ないしは国際機関)が形成したルールが国内公法に取り入れられ実施される際に生ずる諸問題について言及した。素材としては、環境アセスメント制度の導入を定めたEC指令がドイツ法で実施された過程を選定した。したがって、本研究は、公法学の基本問題のみならず、環境法(とりわけ環境アセスメント制度)、EC法(とくにECの立法諸形式)、都市計画法に関し、新しい研究分野を開拓したものである。本研究の具体的成果は、次の4点に整理することができる。第1は、EC法で環境アセスメント制度が確立した結果、同手法は英米法、大陸法を問わず広く国際ルールとして承認され、わが国も今後、同制度の法定化を迫られることとなる。第2は、国際ルールの形成にあたっては、協議のための組織及び手続が重要となる点が明らかにされ、今後はとりわけ、こうした国際間の手続原則の解明が必要であると考える。第3に、国際ルールを国内法にとり入れる際には、一方で、独自の文化的、社会的背景をもって発展してきた各国の公法システムへのインパクトが少なくなるような配慮が必要であり、しかし他方で、一国内でしか理解を得られない行政慣行などは変革せざるをえない点が明らかとされた。第4には、超国家機関の組織編成と国内機構の組織編成に共通点が見られる場合に、2つのシステムがうまく機能することが確認された。つまり、広域主体がより狭域の主体の利害に配慮を払うような仕組み、すなわち、「下からの合意形成の尊重」という視点が不可欠となることを指摘した。

(1)This paper studies the problems arising from the acquisition and implementation of domestic public law by a plurality of countries (including international organizations). The introduction of environmental protection systems is determined by the EC Directive on the implementation of environmental protection systems. This study focuses on basic issues of public law, environmental law, EC law, urban planning law, and new research areas. The concrete results of this study are summarized in four aspects.
