本研究はいわゆる「子どもの権利に関する条約」(公定訳では「児童の権利に関する条約」)の第12条の意見表明権につき,国際機関のレベル及び本条約を批准した各国レベルにおける議論の動向を分約することにより,子供の意見表明権の原理的意義および制度的意義を明らかにすることを目的としていた。一年間の研究により,以下の成果をあげることができた。まず,国連子どもの権利委員会による第12条の解訳の進展として,第12条を個々の子どもの手段的権利を保障したものとの解訳に加えて,集団としての子どもの参加権を保障するものとの翻訳を行っていること。そして,個人的手段的権利として(あるいはその発展形態として),子どもが自ら救済機関にアクセスする権利を承認していることを明らかにしえた。また,子どもの参加権及び手段的権利につき,国際準則における発展の状況を明らかにした。この領域においては,養子縁組,里親委託など家族法領域において,子どもの手段的権利の保障の動向が顕著であるほか,少年司法の領域においても同様の傾向が見られれことが明らかになった。以上のような成果があったが,CEにおける「18未満の者による権利行使に関する条約」草案の分権,および英米における子どもの権利についての理論動向については第一次資料の入手・整理にとどまり,今後の過題として,これらの資料の分析とその成果の公表が残されている。
