本年度は、当初の研究計画に示した第一段階の作業、第二、第三段階の作業の一部を行った。第一の作業として設定したのは、クレジット・カード会員規約の検討、及びクレジット・カードにかかわる下級審判例の検討である。前者では、(1)会員規約の文言に変遷がみられ、概して適切な内容に向かっていること、しかし、(2)いまだカード利用者に酷な条項や不適切な条項を含むと考えられること、また(3)使用される用語の中には一般消費者が理解できるか否か疑問の存するものがあることが明らかになった。後者では、今年度中に公表された関連裁判例は少ないものの、過去の裁判例を総合すると、カードの他人使用、及びいわゆる「使い過ぎ」の事例が紛争の主要課題であることが明らかになった。なお、クレジット・カードの第三者使用にかかわる最新公表判例(大阪地判平成6年10月14日判タ895号166頁)については、判例研究を準備中であり、今年中に公表する予定である。第二の作業として設定したのは、外国法の参照である。主として念頭に置いていたのはアメリカ法であったが、入手できた文献がイギリス法・ドイツ法に片寄ったことから、アメリカ法についてはやむを得ず少し古い文献を参照し、さらにドイツの消費者信用法も一部参照の対象とすることとした。第三の作業として設定したのは、外国法の検討である。わが国での主要課題であるカードの他人使用、及び「使い過ぎ」を中心に検討した。わが国に参考となる考え方も存在するが、わが国の特殊性、当該国の特殊性などを考慮し、その在り方を慎重に検討した。
