わが国の人身賠償論は、交通事故における賠償論を中心として発展してきた。ここでは、人間の価値を専ら労働力の喪失という観点からのみ評価するにすぎず、それゆえ人身被害により将来得られるはずであった収入額の減少または喪失を基礎に主に逸失利益を算定してきた。しかし、この逸失利益を中心とする賠償論では、今日被害者や遺族が被っている経済的損失にとどまらない多方面にわたる人身被害に対応できず、賠償範囲が狭いことになる。そこで、本研究は、アメリカのSherrod v. Berry判決を契機として、人間の生命の価値そのものについて賠償を試みるHedonic Damages理論について考察した。その結果、人間は労働するために生きているのではなく、人生を享受するために生きていることを基礎に、経済的・道徳的・哲学的価値など生命を保持しうる全ての価値を含む人間の価値全体として捉えられた「生命の喪失」という非財産的損害を金銭評価すべきであるとの示唆を得た。そして、この生命の喪失について金銭評価する方法を考察するため、アメリカの生命評価に関する研究を幾つか収集し分析した。今後の課題として、アメリカの生命評価の研究にも幾つかの方法があり、それにより評価資料や賠償額に差異が見られるので、わが国においてどの方法が最も適合するかという観点から考察を深めたい。さらに、わが国の現在の算定方法による賠償額を把握し分析した上で、アメリカの生命評価の研究に基づく生命の喪失の評価方法によればどれだけ高額の賠償額を創り出せるか検証したい。

In this paper, the author analyzes the method of calculating the compensation amount in China, and studies the method of evaluating the loss of life in China.
