本研究は、現在の賠償法理は理論的限界に達しているとの問題意識に基づき、人身損害賠償の比較法的・理論的研究の成果を踏まえながら、わが国の人身損害賠償全体のあり方について再検討した。公平・平等を唱える現代社会においてどれくらいの金額であれば、被害者及び遺族の生活を保障するものであるか考察した。その結果、現在の賠償システムでは欠落していた被害やそもそも認識されることのなかった損失をも賠償の対象とし、身体的・精神的・社会的・経済的に被っている広範な損失を「適切に」評価しなければ、結局被害者は救済されないことを明らかにした。また、本研究は、生命の価値について相場を形成することをめざしているため、現実にわが国の交通事故の事例で、どのような被害者がどのくらいの補償額を得ているか実態を把握し分析する必要があった。そこで、『交通事故民事裁判例集』の一部について、幼児・学生・主婦・有職者・無職者などの被害者類型ごとに、性別、年齢、裁判年月日、裁判所、損害項目ごとの賠償額、逸失利益の算定方法、賠償総額、過失相殺の有無などの項目について調査した。今後の課題として、『交通事故民事裁判例集』の残りについて同様の調査を行い、それと共にアメリカの「生命評価の実証研究」についてわが国においても利用可能なものであるか検証したい。これらにより、身体的・精神的・社会的・経済的に被っている広範な損失を金銭評価する方法とその指針を得たい。

Future topics include the investigation of "Traffic Accident Civil Judgment Case Collection" and the investigation of "Life Evaluation and Evidence Research". In this case, the physical, mental, and social aspects of the problem are discussed in detail.
