わが国の人身損害賠償理論の在り方を再検討するための予備的考察として、アメリカ人身損害賠償の最新のHedonic Damages理論について研究を行った。具体的には、1.Hedonic Damages理論に関する文献(著書・雑誌論文・判決)を入手可能な限り収集し分析した。これによりHedonic Damages理論がアメリカ人身損害賠償法上出現するに至った経緯や従来の賠償理論が抱えていた問題点を明らかにした。すなわち、従来の死亡被害者の死亡により遺族が被った金銭的損失のみの賠償や、金銭的損失の枠を拡大した形での非金銭的損失の賠償の取り込みでは、死亡被害者の失われた生命の価値、生きることから得られる楽しみを無視し、現在の損害賠償システムは生命侵害に基づく損失を過小評価しているという根本的な批判がなされた。2.Hedonic Damages理論について判断を下した判決を分析し、Hedonic Damages理論が裁判所によりどのように採用されまたは採用されないかに関し、その論理や理由付けを検討した。本来、Hedonic Damages理論は、生きて生活する場面における非金銭的損失の方が労働する場合における経済的損失よりもむしろ大きな価値があると問題提起をし、これにより人間の生命の価値を直接的に評価しようとする試みである。しかし実際は、Hedonic Damages理論は必ずしも本来の意味で適用されず、人身障害における「人生の楽しみの喪失」の意味で用いられ賠償されることが多かった。Hedonic Damages理論が有する人身損害賠償法上の意義と評価について検討した。Hedonic Damages理論は従来考慮されることのなかった社会で生きていく上での喜びを経済的価値とは異なる道徳的・哲学的価値を含む生命の価値全体として構成し、これに賠償の可能性を示唆した点で重要と言える。
