项目摘要

私は、「規制と競争」あるいは「私的性格と公的性格」との相剋を円滑に処理することが邦銀経営にとって今日的な課題であるとみて、これを解決するのに必要な理論的フレームワークを構想するということに中期的な研究課題を設定している。いわゆる「住専処理問題」にみられたように、金融自由化と表裏一体をなしている邦銀の「自己責任経営」は、行政、銀行経営者、会計監査人、株主などによる邦銀経営のサ-ベランス・システムの構築なくして達成できないと、私には思われるからである。私は、より具体的には、邦銀経営をめぐる行政責任、経営者責任、監督責任という三者の相互関係を分析することを通じて、邦銀経営のサ-ベランス・システムの構築に必要だと思われる「構成要素」を摘出し、それらの「構成要素」を論理的に整序づけるということに研究課題を設定している。今年度は、アメリカ銀行法・証券二法形成過程における「サ-ベランス・システム」の理念および監督手法の摘出に努めるとともに、「二信組」・コスモ信用組合の経営破錠に引続き、1995年8月に発生した木津信用組合の経営破錠を検討した。同信組の破錠問題では、木津信用組合を協同組織形態をとった中小地域金融機関と位置づけ、同組合が経営破錠に至るプロセスと、経営悪化が表面化した地域金融機関に対する行政責任の履行状況を検討した。この研究の成果は、論文「中小金融機関の経営破錠と監督システム」としてまとめられている。この論文では、木津信用組合の「放漫経営」に破錠の直接的な原因が求められているとしても、銀行経営のサ-ベランス・システムの構築という視点から検討することによって、都道府県レベルでの監督責任のあり方や経営行為を批判的に検証するシステムが「不在」であることを明らかにした。
