项目摘要

ヘーゲルの『法の哲学』の研究は、K.H.イルティングや、D.ヘインリッヒらの努力によって1817/18以降に行われたヘーゲルの法の哲学に関する諸講義に出席した聴講者ノート、さらに1820年『法の哲学』公刊以降、ヘーゲルが自家本に書き入れた講義覚え書きなどが蒐集され刊行されることによって、ようやくこれまでの哲学的研究と文献学的研究との跛行状態を克服して本格的な研究が可能となった。こうした現状を踏まえて、本研究は今年度は基本的作業として、イルティング、ヘインリッヒの編集になる年度毎の講義内容の相互比較と、ヘーゲル自家本への覚え書きの訳出に心掛けた。この作業も未だ終わらない今日の時点において研究実績を語るのは早急の憾を免れないが、これまでのところでベルリン全集版に付け加えられたガンスによる補遺がいかに恣意的なものであるか、また聴講者ノートと覚え書きとの比較研究により、ヘーゲルの思想発展を明らかにする一つの手掛かりが得られることが確認できたことは一つの成果といえよう。さらに覚え書きの訳出が完成すれば、これはわが国で初訳となるはずであり斯界に益するところ大きいであろう。成立史的研究について付言すれば、これまでも『法の哲学』と『プロイセン一般ランド法典』との関係、さらに1815年に始まったヴュルテンベルク王国憲法制定会議との関連については指摘されてきたところであるが、後者における国王憲法草案が1814年にルイ18世によって制定されたフランス立法憲章を追うとき、さらに人権宣言以来のフランスにおける立法活動に対するヘーゲルの関心と姿勢を明らかにする必要があると思う。そしてこのことは、惹いてはヘーゲルがイギリスやフランスをどのように観ていたかという問題との対決を不可避にするであろう。
