国造り・街造りの権能、即ち計画高権は、地方自治の最も明確かつ有効な発現形態である。ドイツにおける地方自治の主体であるゲマインデ(市町村)には、計画高権が与えられている。しかしながらこのゲマインデの計画高権は、より広域の単位である郡や州の権能によって制約されることがあるばかりでなく、例えば道路やエネルギーといった個別分野の計画によっても制限を受ける。こうして、本来ゲマインデに与えられている筈の街造りの領域は、上位官庁や専門官庁によって言わば「先取り」され、自治は空洞化させられているのである。本研究はまず、こうした自治体の計画権能の空洞化の原因となる実定法上の諸制度について検討を加え、次いでこうした空洞化を防ぐために自治体が採り得る諸手段、とくに憲法上の自治権保護の機能について、憲法判例を中心に詳細な検討を重ねてきた。憲法上の地方自治の保護としては、元来個人の人権に対する国家権力の規制・介入の合憲性を判定するための基準である「比例原則」、すなわち規制目的の重要性と規制による人権侵害の深刻度との均衡を要求する原則が、ゲマインデの自治権に対する侵害の許容性の判定基準として従来は用いられてきた。しかしながら、1988年11月23日のドイツ連邦憲法裁判所の判決は、この比例原則に代えて、基本法第28条第2項第1文はゲマインデに地域共同体の全ての事務を基本的に包含する任務領域を保障している、という「任務分配原理」を打ち立てた。この新しい基準が、地方自治の保障にとって果たしていかなる具体的な帰結をもたらすかは、まだこれからの問題であり、判例・学説の進展を注意深く見守りながら、現在論文を準備中である。なお、研究分担者である寺尾は、本研究期間の初めにアメリカ合衆国に留学し、アメリカの地方自治と国造り・街造りの実情を視察する機会を得たので、その成果をも取り込んだ研究のまとめを行っている。
