项目摘要

本年度は昨年度に引き続き、ドイツ第二帝政期の社会保険の発展の論理を、1911年のライヒ保険法の具体的な形成過程の分析を通じて検討した。本年度は社会保険改革がひとまず集成された1911年のライヒ保険法の成立の意味をより深く検討し、その積極的意義付け行うとともに、そこにおける国家の役割の検証し、とりわけ旧い19世紀的国家から20世紀的社会国家への移行の端緒としての本法の位置づけを試論的に行った。そこで明らかになったことは(1)ライヒ保険令に向けて政府が重工業や農業利害、また逆に労働組合などとも組みすることなく、独自の論理で統一的社会保険体系の構築、就中各保険部門および在来保険機関をすべて包含する地域主義的集成を行おうとしたこと、(2)産業界の反対によりそれが不可能になったとき、政府は在来三保険部門の各々に何らかの影響力を行使できる「地域保険局」を考案し、それによって平等で、非党派的で予断のない公平な機関を構築しようとしたこと、(ここでも産業界と激しく対立し、一定の妥協を余儀なくされるが、政府はその実現に成功したこと、)(3)そしてまた政府はまだ満たされぬ社会政策的ニーズに直截的に対応しつつ、保険範囲の拡張などに尽力したことである。ライヒ保険法の形成過程でライヒ政府が個々の社会集団の利害を超越しつつ上記の目的に向かって行動したことは政府(国家)の新たな姿勢を如実に表す事柄として重要である。同時にこうした国家の行動指針は従来の帝政国家観やライヒ保険令の意義を等閑視する見解では指摘されてこなかったものである。そこで以上の事項を論文「ドイツ第二帝政期ライヒ保険法の成立過程・・・・その社会政策的意義の再検討・・・・」にまとめ、近く投稿すべく現在準備中である。また本年度は分析の対象をヴァイマ-ル期までひろげることはできなかったが、上記原稿完成後、来年度において詳細に分析していく予定である。
