RESEARCH ON THE REGULATION OF THE ORGANIZED CRIME

该项目的目的是研究日本刑法处理有组织犯罪的方式，并提出可取的改革方案。该项目对日本法、美国法和德国法进行了比较研究。研究的结论是，执法需要重点关注有组织犯罪集团本身，而打击有组织犯罪最有效的工具是没收有组织犯罪集团的违法所得。为了成功地规制有组织犯罪，政府不仅需要改革直接规范有组织犯罪的刑法，而且需要改革其他相关的刑法和民法典。

The purpose of the project is to study the way of Japanese criminal law for dealing with the organized crime and propose a desirable reform. The project has studied Japanese law, American law and German law for comparison. The conclusion of the study is that the law enforcement needs to focus on the organized crime group itself and the most effective tool for combating the organized crime is to confiscate illegal proceeds from the organized crime groups. For the regulation of the organized crime to be successful, it is necessary for the government to reform not only criminal codes directly regulating the organized crime but also other related criminal codes and civil codes.
