The number of doctors prosecuted for medical malpractices has risen in recent years, and this has generated concern among medical professionals. In order to establish the appropriate response of the criminal justice system to medical malpractice, we need to create a new investigative committee and restrict the use of criminal sanctions to the serious cases of medical malpractice through increasing the use of administrative and civil sanctions. Comparative studies of foreign legal systems support this proposal.

近年来，因医疗事故被起诉的医生数量有所上升，这引起了医疗专业人员的关注。为了建立刑事司法制度对医疗事故的适当反应，我们需要建立一个新的调查委员会，并通过增加行政和民事制裁的使用，将刑事制裁的使用限制在严重的医疗事故案件中。对外国法律制度的比较研究支持这一建议。
