Research on current problems of Workers' Compensation Insurance Scheme

本研究试图描述未来的工伤保险计划，以适应新的问题，如疾病或死亡所造成的过度工作或压力。特别是，这项研究侧重于预防、赔偿和受害者的社会-职业重新适应的可能结合。进行了比较法律的研究，特别是对法国和瑞典工人赔偿保险计划的研究。研究工作包括收集关于法国和瑞典法律以及日本法律的文章、书籍和报告，并对它们进行分析。我们的一位研究小组成员前往瑞典采访和收集文件，因为很难获得有关瑞典法律的信息。法国法律更重视受害者的赔偿，而不是社会-职业重新适应，但法国的“Les Caisses regionales”通过补贴以及额外的保险费在预防方面发挥了重要作用。在瑞典，由税收资助的保健服务（包括康复）不仅包括私人生活中的伤害和疾病，还包括工伤和职业病。工人赔偿保险计划基本上提供现金福利，很少考虑预防问题。通过比较研究，可以明确日本工伤保险制度的特点，并对今后制定综合工伤保险制度有几点启示。

This Research tried to describe the future scheme of Workers' Compensation Insurance which might adapt to the new questions such as diseases or death resulted from overwork or stress. In particular, this research focused on the possible integration of prevention, compensation and social-professional re-adaptation of victims. Comparative legal studies, especially studies on French and Swedish Workers' Compensation, Insurance schemes have been done. Research work has been composed of collecting articles, books and reports on French and Swedish laws as well as Japanese law, and of analyzing them. One of our research group member went to Sweden to interview and collect documents because of difficulties to get informations on Swedish law.French law gives more priority to compensation of victims than social-professional re-adaptation, however French "les Caisses regionales" play important role about prevention by way of subsidies as well as an extra insurance premium. In Sweden, health services (including rehabilitation) financed by tax cover not only injuries and diseases in private life, but also industrial injuries and occupational diseases. Workers' Compensation Insurance scheme provides essentially cash benefits, it has few concerns about prevention. This comparative studies allow to clarify characteristics of Japanese Workers' Compensation Insurance Scheme and to have several inspirations on future plan of integrated Workers' Compensation Insurance Scheme.
