本研究を通じて、帝国法制の二大特徴が明らかとなった。第一の特徴は、東アジア国際秩序の政治的サブシステムとしての日本帝国の法的性格である。これは、日本自身の帝国化が台湾領有とほぼ時を同じくする条約改正によって導かれたことに端を発する。西欧列強が東アジアに形成した「不平等条約」を支えていたところの属人的に本国の法制が居留地に滞在する西洋人に及ぶとする治外法権制度を逆手にとり、台湾全土に属人的な民事・刑事全般の基本法制度を敷いたことが、帝国法制の基本構造を決定することになった。つまり、現地での貿易を可能ならしめる生命と財産の保障を、この種の法制を現地に敷くことで責任を持って実行できるとしたことが、イギリス等に台湾での治外法権廃止を認めさせる契機となったのである。こうした列強の意向を常に考慮しながら植民地化を進めるという傾向は、朝鮮の保護国化と併合においても一貫していた。帝国法制の基本構造は、こうして導入された属人的な法制度を本土法の帝国大の属地的延長施行によって徐々に私法の家族法分野にのみ限定していくベクトルと、本土とは異なる委任立法の枠組みによって作られた「外地」でのみ均一な属地的法制によって属人法を解消しようとするベクトルとのせめぎ合いと理解することができる。第二の特徴は、古典的な公法と私法という区分がゆらぎ、行政法、経済法、社会法という公法と私法の二つの性格を混在化させた法分野が増大する時期に日本帝国は形成されたため、私法分野が公法から独立した領域として確立されるよりは、帝国的膨張や現地社会の同化や開発という目的を支える社会形成の機能を背負った私法体系としての性格を当初から有しており、その分、内地とは異なる外地社会のコントロール技術としての行政法、経済法体系が外地法の中でも拡大したことを指摘できる。更に、そうした新しい法分野を支える社会形成の機能を戸籍や民法が担うようになったため、内地法との統合はますます困難となり、むしろ公式帝国を周辺へと膨張させる機能までも外地法は担うようになった。政治的な国際協調が破綻する一九三○年代以後、政治的なサブシステムとしての帝国は大きく性格を変え、自らを究極の規範とする地域形成へと向かうこととなるのであった。

This paper studies the two characteristics of imperial legal system. The first characteristic is the political nature of the Japanese Empire. Japan's own imperialization of Taiwan has been the same as that of the United States. Western European powers formed an "unequal treaty" and decided the basic structure of the imperial legal system of Taiwan. Taiwan's extraterritorial legal system is based on the possibility of trade, the protection of life and property, and the legal system of the species. The intention of the great powers is always to consider the trend of urbanization and integration of the protection of North Korea. The basic structure of the imperial legal system includes the introduction of personal law system, the extension of the implementation of local law and imperial territory, the division of family law, the limitation of local law, the delegation of local law, the organization of delegated legislation, the elimination of personal law system and the understanding of local law and imperial territory. The second characteristic is that classical public law and private law are divided into two parts: administrative law, economic law, social law and private law. The two parts are mixed. The division of law is growing. The Japanese Empire is formed. The division of private law is established.
