1972年〜2001年における司法解剖記録より高齢被疑者・被害者を検索して検討を行った。当期間の解剖事例は2,585例あり、高齢者が被疑者であったものが62例、被害者であったものが385例あった。高齢被疑者の割合は、1972〜1976年には1.4%であったが1997〜2001年では4.2%と増加しており、特に殺人被疑事件の増加が顕著である。1970年及び2000年の高齢者人口率の増加と比して、高齢者の犯罪被疑率は相対的に増加しているといえる。故意犯の動機として注目されるのは、病苦・介護疲れであり、高齢者が被疑者となった事例のうち、殺人被疑事件については2/3が被害者または被疑者の身体的・精神的疾患が大きく関与している。被害者の疾患としては脳血管障害による寝たきり状態という事例が半数を占める。これは殺人被疑事件中、病苦・介護疲れからの心中(無理心中)が約60%を占める高率であるという結果につながるものであり、被害者の年齢が被疑者と同世代の高齢者である事例が全事例と比較してかなり高いことにも大きく関連している。高齢者犯罪の予防として介護者及び要介護者の実質的支援が重要であると思われる。その他の動機でも家族内でのトラブルによるものが92%を占め、全事例では被疑者が判明している事件のうち、家族内でのものが半数であるのに対し、高齢被疑者による事例では92%であり、面識なしの事例はみられない。最も多かったのは夫婦間での犯行であった。また過失犯では医療過誤被疑事件が多いことが特徴的である。分娩、虫垂炎における腰椎麻酔、投薬が主なもので、一般に事故報告事例の多い陣痛促進剤・局所麻酔剤の使用も10例中4例にみられる。医療行為に不適切な点があると鑑定されたものは2例あった。現在、高齢被疑者の処分結果を調査中であり故意犯、過失犯別に、被疑事件の予防と処分のあり方についてさらに検討していきたい。
