成年後見制度改正の基本理念である自己決定の尊重、残存能力の活用といった新しい理念を活かした制度運用がなされるためには、医師による能力判定についても新たな方法論が必要と考えられる。昨年度の本研究の成果から、欧米諸国における医師による財産管理能力の判定は、(1)本人の医学的・精神医学的状態、(2)財産管理に関する本人の思考・行動、(3)財産管理についての客観的な事実(財産管理の規模など)、(4)社会的関係(家族や介護者など社会の他の構成員との関係、援助の必要性・受容)の4つの要素から構成される多次元モデルが採用されていると考えられることを指摘したが、本年度はこうした多次元モデルによる能力判定のわが国への適用可能性について、地域福祉権利擁護事業の利用契約に関する能力判定の分析をもとに検討した。地域福祉権利擁護事業は民法上の委任代理契約によるサービスであり、契約締結能力に疑義のあるケースについては、契約締結審査会(法律、医療、福祉の各領域の専門家より構成)が契約の適否を審査する。東京都における能力疑義による審査事例の分析から、改訂長谷川式簡易知能評価スケール10点以下というような重度の知的機能低下を伴う事例についても契約締結を認められることがあり、審査会による能力判定は、(1)本人の精神医学的状態、(2)利用者による明示の利用意思(援助の受容)、(3)援助の必要性・有用性、(4)本事業以外の手段による本人保護が困難であること(財産の規模など)、を総合して行われていることが明らかになった。審査事例のほとんどが日常金銭管理に関する援助の必要性から地域福祉権利擁護事業の利用を希望した事例であることなどを考慮すると、この結果は欧米諸国と同様の多次元モデルに基づく能力判定のわが国での適用可能性を示唆するものと考えられた。
