刑事精神鑑定は、刑法・刑事訴訟法をはじめとしたさまざまな関連法規とも関係するものであり、精神医学と法律学の学際領域の課題である。医療観察法や裁判員裁判法の施行に伴い、刑事精神鑑定をめぐる新たな議論が行われ、刑事精神鑑定における法曹と精神科医との間の役割分担は明確となった。しかし、刑事訴訟法に基づく鑑定留置中の被鑑定人の処遇については、その実態を含め不明な現状にある。刑事訴訟法に基づく鑑定留置に類似する医療観察法鑑定入院中の対象者の処遇については実務で参照可能なガイドラインが示されているのに対して、精神科病院に鑑定留置中の被鑑定人については、ガイドラインは存在しない。鑑定留置は、被鑑定人の身柄を拘束して行われるものであり、刑事訴訟法に基づく鑑定留置の現状は、被鑑定人の人権擁護の観点からも見過ごすことはできない。本研究は、刑事訴訟法に基づく鑑定留置の実態を明らかにし、鑑定留置中の処遇に関する鑑定人の懸念や対処方法に関する意見を聴取したうえで、刑事精神鑑定の実施に造詣の深い、精神科医と法律学者・弁護士とが協働して、刑事訴訟法に基づく鑑定留置中のあるべき姿について検討し、刑事訴訟法に基づく鑑定留置中の被鑑定人の処遇に関するガイドラインの策定を行うことを目的としている。令和4年度は、各地で刑事精神鑑定を行っている若手を中心とした日本司法精神医学会会員の精神科医を研究協力者として、研究班を組織した。研究班会議で、研究協力者各位の刑事精神鑑定の経験、鑑定留置、特に精神科病院への鑑定留置の実施状況、鑑定留置中に感じた法的・倫理的な問題やその解決方法などについて議論を行った。
