法医解剖(司法・行政解剖)において、採取臓器・体液等の使用目的が鑑定嘱託事項の範囲を超える場合の規制は、特に許諾の取得方法の問題から、なかなか具体的で現実的な原案への到達が困難である。本研究では、主として法医解剖に携わる法医学者の立場の意識調査が必要であり、それが規範作成に重要な資料になるという仮説のもとに企画作業を開始した。そして、種々の懸案事項を検討したところ、1)規範の必要性ならびに危急性、2)規範における規制の対象となるカテゴリー、3)規制の根拠に対する認識、4)教育への使用の妥当性、5)許諾確保の具体的方法、6)倫理審査機関の位置づけ、7)執刀者の裁量、などの項目が調査されるのが有用と考えられた。しかし、本来臓器・検体の研究目的の使用については、研究の形態や目的により法医学研究者の中でも見解に開きがあるほか、特に法医解剖に係る遺族の特殊な感情を考慮すると、執刀者側との認識との隔たりは如何ともし難いと予想され、本件の意識調査を実施してもこの溝を埋めることは困難と予想された。本研究ではこれらのことを検討した結果、本件に係る規範作りには、使用目的限定の模索よりも、むしろ規制の対象となる使用目的を、(1)遺伝子解析、(2)第三者への譲渡と商用取引、(3)鑑定と無関係な研究材料提供のように当初は限定し、包括的な許諾方法を得る可能性について議論することの方の利益が大きいと推論した。
