本研究は、大学の教員や企業が産学連携における倫理についてどのように考えているかということについて調査を実施するとともに、産学連携が先行して成果を上げている欧米諸国の倫理基準を収集することによって、それら倫理基準を総合的に検討し、現代にふさわしい大学の理念と倫理基準を構築することを目的とするものである。このため、本件に関し、日本の国公私立大学教員、米英独仏を中心とした大学・TLO、日本企業を対象にアンケート調査を実施するとともに、米英大学の倫理規程等についてインターネット等による調査を実施した。日本の大学では、研究、教育、産学連携のそれぞれの業務分担を支持する割合が外国の大学よりも高いことや、産学連携に従事する教員の評価の改善を求める声が強かったことなどは特徴的である。また、企業との比較では、企業側が教員の兼業時間の制限を撤廃することを支持する割合が高く、産学連携を重視する姿勢が強い。一方、大学教員・企業ともに、贈与・役務の提供、供応接待、未公開株の譲渡などは国家公務員並みの規制が必要であるとする意見が多かった。なお、責務相反・利益相反の問題は、基本的には外部活動における時間的問題と金銭的利益の問題である。米英の規定等の比較から、教員の外部活動については、社会や大学に対する有益性を明確化し、位置付けた上で、大学に対する責任や義務を周知し、例えば1週間に1日程度の兼業時間制限などを設けることなどが妥当である。また、外部活動で得る金銭等については、情報の開示を基本とし、年1回程度の外部活動や資金受け入れの報告を義務付けるなど、透明性を確保することが必要である。また、大学側も、利益相反の具体的な事例を挙げるなどして、周知させたり、相談・審査の窓口や委員会を整備することなどが必要である。
