项目摘要

平成16年度は、補助金交付期間の最終年度にあたり、判決原本のデータ入力作業に一応の区切りをつけることができた。本年度は、これまで入力したデータの整形(文書形式を整え、個人情報にマスキングをかける等)に時間を割いた。平成14年度には、国際日本文化研究センターのデータベースより123件の判決、大阪大学保管分より64件の判決、合計187件の判決をデータ入力し、平成15年度には、国際日本文化研究センターのデータベースより193件の判決をデータ入力した。本年度は、合計で81件のデータ入力を行った。入力した判決の内容は、金銭関係の判決のうち、とくに「預ケ金」と「地所質入」「地所書入」に関する判決、「勧解」に関係する判決および裁判資料である。とくに、「地所質入」「地所書入」については、仙台高裁管轄内の全地方裁判所分の入力が終了し、両事件の特質を同一地域内で比較検討することが可能となった。また、「勧解」に関しては2005年3月20日現在データベース上で確認できる700件を超える裁判資料(訴状や不調証その他)の分析を行い、必要な範囲で入力を行った。「預ケ金」については東京と大阪の裁判所所蔵分を中心に入力を行った。この3年間の成果は、学会での口頭報告として随時、公表してきた。平成14年6月8日に日本法社会学会(九州大学)で、平成15年10月3日に法制史学会(名城大学)で、それぞれ口頭報告を行い、さらに平成17年4月24日法制史学会(桐蔭横浜大学)での報告を予定している。この一部はすでに、平成15年12月に「勧解制度選好の要因」(『近畿大学法学』51巻1号)として発表したが、今後さらに、3年間の研究のまとめとして、地所質入・地所書入事件を中心に、判決の成立とその経年的変化について比較分析したものを公表する予定である。
