1,2003年8月〜9月にフランスで調査を行った。(1)ヒアリングにより結社法100周年での議論動向を調べ、資料を網羅的に集めた。(2)史料調査により、a)社会カトリック派と急進共和派のアソシアシオン論、b)法成立直後の法適用とアソシアシオンの実態、その後の変遷を明らかにした。2,研究成果を以下のように公表した。(1)2003年5月の日本法社会学会での口頭報告「中間集団はなぜ法社会学の問題になるのか」で、方法論的な課題整理を行った。(2)「アソシアシオン法の法的解説」コリン・コバヤシ編『市民のアソシエーション』大田出版で、比較法的な考察を行った。(3)2004年2月のフランスのVilletaneuseでのフランス社会学会で口頭報告「アソシアシオン法の歴史法社会学」を行った(報告は、報告集をまとめた本の一つの章として出版予定)。3,以上の作業を通じて、次の知見を得た。a)アソシアシオン法は、社団法理ではなく、組合法理であることが比較法上の最大の特徴である。b)法人学説の次元においても常に団体と個との間の緊張関係が認識されていた。c)これらの特徴は、個人主義文化だけではなく、その当時の共和主義の国家理論とも深く関係している。d)法人理論は、民商法上の法人政策の議論にとどまったのではなく、あらゆる法現象を説明しようとした一般理論であった。e)とりわけ団体と構成員の関係を相互領有的に捉えた上で、規約法を重視するオーリューの制度理論は、法現象そのものの生成、動態を明らかにする上で今日も有益である。これらの知見は、我が国の民商法論の法人理論、憲法の中間団体論、歴史社会学の近代化論に対して全く新しい基礎を提供する。現在、「フランス非営利組合法の研究-アソシアシオンの歴史法社会学」という題での著書の最終執筆段階に入っており、来年度での刊行を予定している。
