研究最終年度である本年度においては、前々年度および前年度から継続して分析・検討を進めてきた問題点を一層明確にすべく、主に次の二点について研究を行った。第一に、外国判決の承認執行制度の領域、中でも特に身分関係事件(扶養義務や子の監護を含めた親責任)に関する国際条約、EU条約を整理し、そこでとられている外国判決承認執行制度の枠組と我が国のそれとを比較することにより、我が国における現行制度の問題点をさぐるとともに、制度のあり方を総合的・多角的に検討した。第二に、第一の検討を踏まえたうえで、身分関係事件や非訟事件を対象に、主に立法論として、いかに国壌を越えた権利実現の制度を構築していくべきかを考察した。身分関係事件や非訟事件には、財産関係事件とは異なる様々な問題・特徴があり、財産関係事件を主に念頭においている我が国の承認執行についての現行制度では、対処しきれない問題点があることを指摘し、当該制度の限界があることを明らかにした。そして、そもそも承認という手続をとることが妥当なのか、妥当だとして承認要件、効果をどのように考えるのか、さらには執行段階ではどのような問題があり、それにどう対処していくべきか等を検討し、承認執行制度を体系的に捉えることを試みた。最終的には、我が国の現行制度の下での解釈論の可能性とその限界、さらには将来の条約批准等をも視野にいれた上での国内法改正・立法に向けての提言を試みている。現在は、以上の研究成果を公表するべく、論文執筆の準備を始めているところであり、執筆中の原稿については、筑波法政39号(平成17年9月刊行予定)に掲載する予定である。
