今年度はまず、昨年度中に行っていた比較法研究（子ども中心の審理のあり方について、ＥＵにおけるchild friendly justice（子どもに優しい司法）に関する議論と、オーストラリアにおける家族法改正に関する議論を参照）の成果を、論文として公表した。その際に得た示唆を元に、現在進行中の法制審議会における離婚後の子の養育のあり方についての議論を、手続法の観点から検証した。当初は子の引渡しの執行や身上監護権及び面会交流の取決めなど手続に関する提案もされていたが、中間試案では手続の問題はあまり扱われておらず、特に注目していた、子の意思・意見を反映させて執行手続を調整するという点に関する具体的な提案はなかった。その背景には、親子交流に関する調停・審判の実効性確保のために、強制力をもって調停又は審判の実現を図る方向での法改正をするのではなく、まずは、親子交流支援団体等による支援等により、調停又は審判によって定められた親子交流を安全・安心に行う環境を整備する方向で、法改正以外の選択肢も含めた方策を検討するなど、執行手続の見直しに限らず、幅広く様々な方策について検討することが想定されており、裁判所以外の行政機関との連携が不可欠であることが確認された。それを踏まえて、かねてより行政機関との連携について注目していたベトナムにおける聞き取り調査を行った。ベトナムはそもそも、執行が司法省の管轄となっており、司法と行政の連携が前提となっているのに加えて、最近は子どもの権利条約に従い、Child Friendly Justiceの議論が盛んになっている。今回は特に、Depertment of Children AffiairsのDirectorから、ベトナムにおいて「子の利益」を実現するための試みについて、広報や裁判所との連携、子どもの意見の聴取の方法などを中心に知見を得た。
