本研究は、船荷証券の記載事項ごとの性質を検討することにより、記載の効力を記載事項ごとに再検討しようという構想により平成14年度より開始された。そして、船荷証券による運送品の特定方法に着目して、記載事項を「個性に関する記載」と「数量に関する記載」に分けて分析を進める方針をとった。しかし、その前提として、船荷証券法(統一条約・国際海上物品運送法)の意図する、船荷証券による運送品の特定基準の分析と、この関係で記載事項の中でも運送品の種類に関する分析とを先行させる必要を感じ、まずこれに着手したのち、平成14年度中に論説として成果を公表した。平成15年度は、これを踏まえて、上記分類に基づく記載の分析を進めてきた。現在まで研究により、運送品の特定という観点からは個性の記載と数量の記載では性質において相当の相違があることを確認し、これがそれぞれの効果の点でも相違を生じさせうるものであるとの認識をいっそう強めることができた。また、運送品の種類という、個性に関する記載が問題となるいわゆる「品違い」の場合について、従来なされてきた議論と異なる視点からの議論を展開する可能性を見いだすことができた。そこで、まずは個性に関する記載と数量に関する記載の性質の相違を明らかにする論説を研究成果として公表し、それがいかに記載の効力の問題と結びつくかについて、「品違い」に関するものを含めてさらに各論的検討を進めていきたいと考えている。
