本研究は、現在進行中の第4次産業革命のもとで生じつつある海事産業のデジタル化が海事法にもたらす革新のうち、①自動運航船を用いた運航により生じる責任と②ブロックチェーン技術を用いた運送書類の電子化のもたらす法律問題について検討し、両者について、立法論・解釈論的な提言を行うことを目的とする。以下，①②に分けて，2022年度の研究実績を説明する。本年度は，自動運航船の事故に伴う船舶所有者の責任の検討、自動運航船の事故に伴う造船業者・自動運航プログラム提供者の責任の検討、自動運航船の事故に伴う遠隔操作者の責任の検討を中心に行った。検討に際しては、完全自律運航に至らないレベルを想定し、いくつかの典型的なシナリオを前提とした。基本的には、現行法の過失責任を前提としたスキームで対応しうるが、船舶の自動運航プログラムの安全性の評価の視点をさらに明確化する必要性があることが分かった。運送書類の電子化については、日本国内における立法の動きが加速したため、その動向を踏まえ、UNCITRALモデル法等の依拠する紙の有価証券との機能的等価物というアプローチを前提とする研究を進めることとし、シンガポール等、すでに船荷証券の電子化に関する立法を進めた外国法の検討を踏まえ、立法上の課題を洗い出した。具体的には、船荷証券・海上運送状等に関する現行法の規定に対応する規定のあり方（たとえば、電子船荷証券の発行要件、船荷証券の種類や裏書方法に対応する規定の要否、紙の船荷証券との転換等）のほか、システムの信頼性の要件、システムに対する認証や登録の要否等政策的な視点を含む諸問題について検討した。なお自動運航船の事故に伴う責任に関しては、比較法国際アカデミーにおいて、運送書類の電子化に関しては万国海法会（CMI)において報告した。

This study aims at the development of the fourth industrial revolution in maritime industry, the innovation of maritime law, the responsibility for the operation of automatic ships, the legal problems of the electronic transportation of books, the discussion of legislation and the discussion of solutions. The following is an explanation of the research achievements in 2022. During the year, the investigation of the responsibility of the owner of the ship associated with the accident of the automatic ship carrier, the investigation of the responsibility of the shipyard associated with the accident of the automatic ship carrier and the investigation of the responsibility of the remote operator associated with the accident of the automatic ship carrier were conducted in the center. In the discussion, the premise of complete self-discipline operation is to set up a typical navigation system. The basic premise of fault liability under the existing law is to clarify the viewpoint of safety evaluation of ship automatic navigation. The electronic transportation of books in Japan has been accelerated by the legislative movement, the development trend, the UNCITRAL Law and other laws, and the functional equivalence of paper and securities. The specific aspects of the regulations related to ship-borne securities and offshore transportation documents include the following aspects: the requirements for the issuance of electronic ship-borne securities, the requirements for the types and methods of ship-borne securities, the requirements for the exchange of paper ship-borne securities, the requirements for the information system, the requirements for authentication and the requirements for registration. The responsibility for accidents involving automatic ships is related to comparative law, and the electronic transportation of books is related to the International Conference on Maritime Affairs (CMI).
