项目摘要

PD第三年目はJ.ロールズの後期政治哲学を研究した。現在政治哲学は「討議論的転回」という局面を迎えている。この転回が意味しているのは、民主的な政策決定は単なる投票ではなく、市民たちの理性的な討議に直接基づいて行なわれるべきだという理念が民主政の新たな像として浮上してきているということである。この契機になったのはロールズの分析的倫理学と政治哲学である。本研究ではとりわけ「公共的正当化」という理念をロールズが提示する「公共的理性・理由public reason」という「理由付け」について構想に基づいて再構成することを行なった。公共的正当化とは民主社会における正当化についての統制的理念である。「誰が選挙権を有するのか」、「如何なる宗教が許容されるべきであるのか」、「如何なる人に対して機会の公正な平等や財産の保有が保障されるべきであるのか」といった憲法上の本質や基礎的正義に関わる事柄が問題となっているときには、我々は社会の一員として他の同胞市民に対して、彼らにとっても共有可能な公共的理由を示すことによって自らの立場を主張しなければならないことをこの理念は要求している。ロールズは公共的理由を全ての市民が重視しており、それゆえ理性的に受け入れ可能な「政治的諸価値」(基本的諸自由の尊重、常識的知識の基準と手続き、ならびに、異論の余地が無い科学の諸方法や諸帰結の遵守)にのみ基づいた理由として定義している。本研究の成果として以下のことが分かった。(1)公共的正当化においては諸制度や法の正しさ(正義)とともにそれらの「正統性」が明示的に擁護されなければならず、(2)この正統性は権力や数多性ではなく、我々の公共的理由のみが確立しうるものであり、(3)我々の社会は公共的な理由に基づいて政策が決定される「理由の空間」となることによって、真に民主的な社会になりうる、と理解するに至った。
