项目摘要

昨年からの課題を延長する形で,研究活動をした。具体的には,昨年までの研究で,アメリカの「表現の自由」論,特にポルノグラフィをめぐる議論においては,「表現の自由」を貫こうとするリベラリズム側と,ポルノグラフィを「女性の権利」の侵害であると糾弾するフェミニストの間で,理論的断絶があることが確認されたが,その断絶を如何に克服していくか、という関心から,文献を参照した。その中でも,昨年から注目しているドゥルシラ・コーネル(Drucilla Cornell)の議論の理解を深めることに時間を割いた。その結果,コーネルの議論は,フェミニストの立場からなされるものであっても,普遍的な憲法解釈に馴染み,上記の理論的断絶を克服する可能性を秘めたものであると考えた。その第一次的な理由は,コーネルがポルノグラフィの問題において,男女にとっての共通概念(「イマジナリーな領域」への権利The right to imaginary domain)を用いているからである。「イマジナリーな領域」への権利は精神分析と結合して主張されるが,少なくとも憲法学にひきつけて考えれば,人間が自己(アイデンティティ)を形成する精神的な環境を整えるという趣旨の権利概念であり,憲法が保障する精神的自由のメタにある権利を主張していると考えられる。コーネルは,ポルノグラフィが先の権利の侵害を引き起こしていると論じ,彼女独自のゾーニング規制を提案している。この研究成果は,同テーマで提出済みだった論文が,修正する機会をその後与えられたため,そこで活かした。(「憲法解釈とフェミニズムの視点-ポルノグラフィ論を素材として-」,東北大学出版会『セクシュアリティと法』所収)
